Fire Safety and Property Maintenance Inspection Program

New York State Executive Law § 381 directs that the cities, towns, and villages of the State shall be responsible for enforcing the Uniform Code.  Article 18 of the Executive Law (§§ 370 through 383) establishes the State Fire Prevention and Building Code Council, directs the Code Council to promulgate and maintain the Uniform Code, and charges each city, town, and village in the State (with the exception of the City of New York) with the duty of administering and enforcing the Uniform Code within its municipal boundaries.

As such, all places of public assembly with an occupant load of 50 persons or more, building whose use or occupancy classification may pose a substantial potential hazard to public safety, manufacturing, storing or hazardous materials, explosives and fireworks, parking garages, open flames/ hot works, mobile food preparation vehicles, energy storage systems will require an annual Operating Permit. Multiple- family dwellings (3 or more dwelling units), and non-residential establishments will be subject to periodic fire-safety and property maintenance inspections not to exceed at least once every (36) months by the Town of North Castle Code Enforcement Personnel.

All properties must fill out and submit the required Fire Safety Application either by email (permits@northcastleny.com)or mail, along with the correct fees listed below, and we will contact you to schedule the inspection. For each building and or mixed use building shall require a separate fee for each occupancy, and/or business present.

Note: 
  •  Mixed use occupancy requires a $250 fee per occupancy.
  • Each building requires a separate fee of $250.
  • Places of assembly over 100 requires a fee of $350.

Properties that are in compliance will receive a Certificate of Compliance that must be notably displayed on the premises. The Certificate of Fire-Safety Compliance can be submitted to your insurance company and you may qualify for a discount.  

Properties that are not in compliance shall be issued a notice to correct the violation. If the violation is not corrected by the time of re-inspection, the owner shall be subject to penalties listed under Chapter 127 of the Local Law.

Failure to allow the required inspection and/or pay the required fee is a violation of the Town Code and may be subject to additional enforcement action as set forth in Chapter 127-15 of the Town Code.
